About This Blog

“Knowledge is power.” That phrase could not be any more true than for the injured or disabled worker.

The injured worker often first learns about workers compensation law from his employer or its insurance company. From the outset, the interests of the employer and the insurer are to limit the cost that the injury will cause them. They don’t care about the cost of the injury to the worker. While they sometimes tell claimants the truth, those statements are half-truths that omit information that is not in their interest to share.

Disabled workers are bombarded with advice from arm chair lawyers that is often incorrect. The pamphlets issued by the Social Security Administration often seem to be written in a foreign language. It is difficult to understand why one has been denied benefits when another, who appears to be perfectly healthy, is receiving benefits.

Every injured worker should contact a lawyer as soon as possible, so they have the knowledge they need to protect their interests. But few claimants contact lawyers at the beginning of their claim unless their claim has been denied. Lawyers are intimidating. It is hard to know whether the lawyer has the right skills and knowledge. Hiring a lawyer requires a leap of faith. And there is always concern about what the representation will cost.

The intent of this blog is to provide workers with the information that they need as early as they can find it and absorb it. I intend to educate workers about what they need to know so they know when they need to find a lawyer. I intend to educate workers so they can find the right lawyer. Make no  mistake, I believe that every claimant should be represented by a lawyer. Hopefully the information they learn here will make them seek that lawyer sooner.

At the same time, I intend to share information, opinions, ideas and strategies with my fellow professionals. Every lawyer stands on the shoulder of his predecessors. Every lawyer learns valuable information and skills from other generous lawyers. Lawyers who share their information, skills and insights generously are able to call on a large network of likeminded professionals to untangle a novel problem. Likewise, they are able to call upon others for insights and perspectives to the benefit of their clients. I hope to return some of the bountiful generosity I have received from my colleagues through this blog.
